. The appeals court held that the deputy could not maintain a First Amendment claim based on his alleged fear of future disciplinary action based on his speech. The deputy had taken his personal firearm firearm, device consisting essentially of a straight tube to propel shot, shell, or bullets by the explosion of gunpowder. Although the Chinese discovered gunpowder as early as the 9th cent., they did not develop firearms until the mid-14th cent.  to a local business for servicing and became involved with a dispute involving the servicing of the weapon. A representative of the business said he knew the sheriff and would call him and complain of his conduct. The deputy responded by saying he would inform the deputy sheriffs association that the business was providing poor service. A complaint was filed against the deputy alleging that he misused his position. The deputy received a three-day suspension for "conduct unbecoming Conduct Unbecoming is a play by Barry England. The plot concerns a scandal in a British regiment stationed in India in the 1880s. The widow of a heroic officer is assaulted by an unrevealed comrade in arms and an investigation takes place to determine his identity. ." (San Diego County Sheriffs Department, California)
