Henry yesterday in Worcester Superior Court. Mr. Powell and Vinnie Ruscitti, 18, are charged with first-degree murder in the Jan. 6, 2006, stabbing death of 21-year-old Daniel Columbo during a fight outside Mr. Columbo's Milford home. Both suspects were 16 when they were charged in the slaying. Their lawyers had sought to have the charges dismissed in a motion challenging the constitutionality of a state law requiring that murder suspects between the ages of 14 and 17 be tried as adults.
