Torco International Corporation Files Suit Against General Sales and Service, Inc.

The city lies in an oil and natural gas region and has diversified manufacturing. , Calif. -- On March 16, 2006, Torco International Corporation filed suit against its former licensee General Sales and Service, Inc., DBA Torco Racing Fuels, for trademark infringement Trademark infringement is a violation of the exclusive rights attaching to a trademark without the authorization of the trademark owner or any licensees (provided that such authorization was within the scope of the license).  and trademark dilution Trademark dilution is a trademark law concept forbidding the use of a famous trademark in a way that would lessen its uniqueness. In most cases, trademark dilution involves an unauthorized use of another's trademark on products that do not compete with, and have little connection . Following a public announcement on July 20, 2005, to discontinue using "Torco" in their name, General Sales and Service has nevertheless continued to use "Torco Racing Fuels" as a trade name and the "Torco" mark on goods and on its websites after termination of its license and without permission from Torco International Corporation. The complaint alleges that Torco International Corporation has owned the mark since 1955 and this use of the Torco name constitutes infringement of the trademark.
