TO: ALL PERSONS OR ENTITIES WHO PURCHASED OR OTHERWISE ACQUIRED A JACUZZI-BRAND DESIGNER SERIES WHIRLPOOL BATH BETWEEN JANUARY 1, 1997 THROUGH MARCH 1, 2003 (the "Class Period"). The San Diego based law firm of Finkelstein & Krinsk LLP hereby provides notice that the marketing and advertising used by Jacuzzi Inc. and its subsidiaries ("Jacuzzi") for its Designer Series Whirlpool Baths falsely represented that the Baths were equipped with 2 or 3 horsepower electric motors (depending on the Bath model purchased). The true horsepower output was approximately half this amount which affected the flow rate of jetted water. The resulting lawsuit has been certified as a national class action by Order of the Superior Court of California for San Diego County. Jacuzzi is accused in the complaint of various misrepresentations and violations of warranty with regard to its Designer Series product line. Class Counsel requests that members of the Class review their purchase records and related materials and preserve all documents that evidence the purchase of a Jacuzzi Designer Series Whirlpool Bath from February 1, 1997 to March 1, 2003.
