 comic Joe Restivo, 56, of Valley Village wants everyone to know he's still alive and working, so to stop sending the flowers and making condolence calls to his wife, Maryanne.

It was former stand-up comic Joe Restivo, 54, of West Hills, longtime owner of Vitello's restaurant in Studio City, who died earlier this month of lung cancer lung cancer, cancer that originates in the tissues of the lungs. Lung cancer is the leading cause of cancer death in the United States in both men and women. Like other cancers, lung cancer occurs after repeated insults to the genetic material of the cell. .

Both men lived in Chicago during the '70s on the same street, although miles apart. Both made their names as stand-up comics, and both later moved to the San Fernando Valley San Fernando Valley

It turns out an entertainment industry Web site mistakenly ran her husband's credits and picture in an obituary.

The still-living Joe never met the late Joe, but did meet his brother, Steve, who co-owned Vitello's until the restaurant was sold last year.

It's always been a popular eatery in the Valley, but gained national notoriety in 2001 because actor Robert Blake Robert Blake may be:

 had dinner with his wife, Bonny Lee Bakley, there the night she was killed.

``My condolences go out to Joe's family, but I need people to know it wasn't me,'' said Restivo, who has more than 100 television credits to his name, and often performs at Reno casinos.

``I called the director of a movie I was supposed to start in September, and found out he was recasting the part because he thought I was dead.

``Friends in the business were calling my wife to offer condolences, and were shocked when I picked up the phone.

``My 14-year-old son had teachers at school stop and tell him how sorry they were his dad had died. He didn't take the news well. The poor kid didn't know about the other man with the same name as his dad.''

Don't get him wrong, Joe says, he's touched that so many people have called his family with condolences, but he needs to set the record straight because he still has a living to make.

``Hey, I'm not complaining; I appreciate all the calls. I'm just mad at the people I know who didn't call,'' said Joe, kidding.

It's nothing short of amazing that an effort Carolyn Blashek started in March 2003 in her Encino living room -- trying to fulfill the wish lists of soldiers who were not getting any mail or packages from home -- has grown to more than 200 volunteers and thousands of donors.
