The lawsuit alleges that former company employees, Michael S. Fitiak, Douglas K. Kollmorgen, Ross C. Terrell and John M. Wynne breached contracts of employment with BOC and certain of its predecessors. The lawsuit further alleges that the four former employees and Inhalon conspired to, and did, misappropriate mis·ap·pro·pri·ate tr.v. mis·ap·pro·pri·at·ed, mis·ap·pro·pri·at·ing, mis·ap·pro·pri·ates 1. a. To appropriate wrongly: misappropriating the theories of social science. and misuse trade secrets of BOC in an attempt to manufacture and market versions of the anesthetic drugs isoflurane and enflurane to compete with those manufactured and marketed by PPD and Ohmeda Caribe. BOC also alleges that John P. Curran and Curran Capital Management joined in the conspiracy. Inhalon, based in Bethlehem, Pa., was established in 1991 and was recently acquired by Medeva, a major British pharmaceutical company, for $54 million. Inhalon plans to begin selling the drugs in April 1995, according to public statements issued by Medeva. The BOC Group is a $5.2 billion, U.K.-based company that has businesses in health care, industrial gases, vacuum technologies and distribution services. Ohmeda, the healthcare business of The BOC Group, is headquartered in Liberty Corner, N.J., employs approximately 5,300 people in 30 countries and had revenues of about $800 million in 1994.
