Thomas J. Macnish claims one of his passengers stuffed a hot Carl's Jr fry down the back of his shirt during a lunch break on the first day of school. When Macnish jumped outside to remove it, his lawsuit alleges, he was run over by his own car, which had been shifted from park to reverse by a second passenger.

Macnish's lawyer, James O'Callahan, contends the passengers were negligent in driving him back to school instead of taking him to a hospital.

Macnish has since graduated from Agoura High.

``The young man almost lost his leg,'' O'Callahan said. ``He was airlifted to UCLA UCLA University of California at Los Angeles

 (Medical Center) and underwent a series of surgeries.''

Chrysler attorney Steve Hantler said ``we regret any time anyone is injured with one of our products,'' but asserted that Chrysler's minivans are among the safest vehicles on the road.

``Whether you have a minivan or a can opener, if someone improperly uses a product . . . accidents can happen,'' Hantler said. ``There's nothing for which Chrysler should or would be responsible for if this was caused by the horseplay horse·play

The passengers could not be reached for comment.

Macnish's suit was filed by the same law firm that recently got a $760 million verdict for 38 former Lockheed workers.

Carl's Jr is not a defendant in the complaint, despite some similarities to a recent lawsuit involving McDonald's and a spilled cup of hot coffee.

The accident occurred after a visit to the drive-through at the restaurant on Kanan Road.

Macnish claims his passenger in the back seat ``intentionally'' placed the fry down his back. He was injured when he tried to stop the car from moving, the suit said.
