TADPOLES MAY SLOW PROJECT ARROYO TOAD ENDANGERED.

SANTA CLARITA - Transit Mixed Concrete Inc. has asked for a continuance of the coming public hearing on the proposed Soledad mining project, saying it needs time to evaluate the discovery nearby of the endangered arroyo toad, officials said Friday.

The Los Angeles County Regional Planning Department then asked the Board of County Supervisors to extend TMC's request to 60 days to allow federal agencies also to review the findings.

``The U.S. Fish & Wildlife Service and the Bureau of Land Management need some time to assess this new information,'' said Brian Mastin, TMC's environmental affairs manager. ``It's in everybody's interest not to have a hearing before this issue is resolved.''

The tadpoles were discovered by a biologist hired by the city of Santa Clarita to survey the area to support its lawsuit against the U.S. Fish & Wildlife Service. The suit claims the federal agency violated the Endangered Species Act The federal Endangered Species Act of 1973 (ESA) (16 U.S.C.A. §§ 1531 et seq.) was enacted to protect animal and plant species from extinction by preserving the ecosystems in which they survive and by providing programs for their conservation.  by failing to study the effects of the mine could have on five rare species, including the arroyo toad.

The Board of Supervisors directed county planners on Tuesday to review the finding of the endangered toad and report back to the board within a week about its significance and what should be done next.

TMC, a division of the foreign-owned Cemex Corp., wrote in its Environmental Impact Statement that its habitat protection plan will protect aquatic and riparian riparian adj. referring to the banks of a river or stream. (See: riparian rights)  habitat in the Santa Clara River adjacent to the project.

The Board of Supervisors has rejected TMC's proposal to mine 56.1 million tons of sand and gravel in Soledad Canyon, south of the Antelope Valley Freeway The Antelope Valley Freeway is a freeway in Los Angeles and Kern counties in southern California. It is signed as California State Highway 14 along its length. It connects Greater Los Angeles to the rapidly developing Antelope Valley. . The supervisors were scheduled to hear a long list of environmental mitigation measures proposed by city officials at the meeting.
