Detectives recovered a semi-automatic gun believed to have been used in the shooting, Flynn said.

The events that led up to the shooting began earlier Sunday, at O'Donnell's Irish Pub on Highway 99. Smith was there with a 26-year-old man, who lives in the Maple Manor complex.

While there, the pair argued with Gilbert, who lives downstairs from Smith's friend in the same building, Flynn said.

"They had some kind of disagreement, but I'm not sure what it was about," she said.

Later that night, Smith and his friend went to Gilbert's apartment, said Dan Allen Dan Allen (1973 to present) is a stand-up comedian currently based in New York City.

Allen has had considerable training in improvisation from the Upright Citizen's Brigade and has performed regularly at the World Famous Comic Strip.
, who also lives in the apartment complex. Allen said a neighbor told him that Smith and his friend would not leave, so Gilbert brought out his gun intending to hit Smith in the head. Police could not confirm details of the neighbor's account Sunday.

A man who identified himself as Gilbert's father, but declined to give his name, said he spoke to his son shortly after the shooting.

"All he could say was that it was an accident," he said. "He was trying to make them leave, got his gun out and it went off."

The man also said his son and Smith's friend had a long-standing dislike for one another.

"It was a noise thing, a music thing," on the part of Smith's friend, he said.

Allen said Gilbert kept mostly to himself, while Smith and his friend "just like to have fun."

Forensic detectives were at the apartment until about 4 p.m. Sunday, and the case remained under investigation, Flynn said.
