Support for older instruments.

Q Several of my lab customers use a specific model of instrument on which the manufacturer claims the new version of software, due out within the year, will not be supported. Do any provisions or regulations exist to prevent an instrument manufacturer from discontinuing a piece of equipment without providing a substitute or replacement in the event that a lab's instrument stops functioning?

A No rules or regulations require a manufacturer to support a device after a business decision has been made to discontinue its use. The manufacturer probably has a good reason for not supporting the old technology, such as the introduction of an improved device. For instance, the new device might offer higher throughput, or it might be safer, more accurate, less labor intensive Labor Intensive

Several independent companies support older devices and supply refurbished equipment. You might look for support from one of these companies. One way we have avoided this problem with instruments has been to use "cost per test" contracts instead of purchasing instruments. This has proved financially advantageous and assures us of having support from the manufacturer.
