I am being charged we second degree felony assault, the man who is accusing me grabbed my girlfriend and threw her across the lobby of my apartment, we then
 murder petitioned for habeas corpus habeas corpus (hā`bēəs kôr`pəs) [Lat.,=you should have the body], writ directed by a judge to some person who is detaining another, commanding him to bring the body of the person in his custody at a specified time to a  relief. The district court denied the petition, finding that the alleged "nightmare" experience of the offender when he used a prison law library did not warrant equitable tolling of the one-year limitation period under the provisions of the Antiterrorism and Effective Death Penalty Act (AEDPA).
