LandWatch Arguments Rejected Again

MONTEREY, Calif. -- On January 23, 2007, a three judge panel of the California Sixth Appellate District (San Jose San Jose, city, United States

) in a unanimous ruling upheld Superior Court Judge Robert O'Farrell's ruling of January 25, 2005 that the Monterey County Board of Supervisors The examples and perspective in this article or section may represent an unduly geographically limited view of the subject.

correctly granted a permit to Prunedale contractor Don Chapin on May 4, 2004 to build Cathrein Estates. The appeals court rejected the claims of LandWatch Monterey County saying, "In proceedings before the Planning Commission Noun 1. planning commission - a commission delegated to propose plans for future activities and developments
commission, committee - a special group delegated to consider some matter; "a committee is a group that keeps minutes and loses hours" - Milton Berle
, the Board, the Superior Court and now this court, LandWatch has failed to cite substantial evidence to support fair argument of a significant adverse impact." Cathrein Estates is a planned 28 home subdivision on 143 acres in north Monterey County.

LandWatch had complained that Chapin's approval was in violation of the California Environmental Quality Act The California Environmental Quality Act (CEQA) is a California law (California Public Resources Code section 21000 et seq.) passed in 1970, shortly after the Federal Government passed the National Environmental Policy Act.  (CEQA CEQA California Environmental Quality Act of 1970 ), the County General Plan and that Chapin had not done a good job in planning for the site.

Don Chapin, President of Don Chapin Company, Inc. said, "The Court was not fooled nor should the public be fooled. LandWatch can insist they are representing the interests of the public, but truly they are not. The Supervisors in their original decision followed the rule of law as did our application. I always knew justice would prevail as does the facts in this and many other cases and issues. LandWatch can not conjure up conjure up

a set of supposed facts and expect to prevail. The real facts and the truth always win. LandWatch has long been assaulting good projects and legitimate businesses here in Monterey County. In this case, though justice prevailed, consider the injustice of horrendous cost in time and money. Think for a minute what good we could have done with all that. I am hopeful that the people will eventually see through this abuse of the public process and decide enough is enough!"

, attorney for Chapin said, "It seems inconsistent for LandWatch, a supposed pubic education organization to be filing and funding law suits. This is, I believe, the third such loss in the courts by LandWatch in as many years. In each, the courts cited a failure of evidence and incorrect legal interpretation."

Chapin intends to begin site preparation at Cathrein Estates and start construction as soon as possible.
