 to two plaintiffs who were Comcast Cablevision of Philadelphia customers who believed they were overcharged with exorbitant late fees for overdue OVERDUE. A bill, note, bond or other contract, for the payment of money at a particular day, when not paid upon the day, is overdue.

With this Court certification, the thousands of consumers of Comcast Cablevision of Philadelphia who paid late fees from December 24, 1991 through the present are automatically included in a law suit seeking financial recovery for their payment of excessive late fees.

"Under current law, a company can only charge late fees that are reasonably related to the cost the company incurs," said Jeffrey Kodroff, co-lead counsel for the new class and a partner in the Philadelphia-based Spector & Roseman. "In other cable late fee cases, courts have found that late payments cost companies no more than approximately 50 cents, but Comcast was charging its customers $6 which is 12 times that amount."
