PRISONER ON PRISONER ASSAULT

Smith v. Muccino, 223 F.Supp.2d 396 (D.Conn. 2002). A state prisoner one in confinement, or under arrest, for a political offense.

 brought a pro se action alleging that the practice of housing him with violent inmates, sometimes in retaliation RETALIATION. The act by which a nation or individual treats another in the same manner that the latter has treated them. After an agreement to settle the case fell through, the court reopened the case and held that the prisoner's allegations stated a claim for an Eighth Amendment violation. The court noted that the prisoner was not claiming that double-celling was per se unlawful. The prisoner, who is Caucasian and who believes he is perceived to be gay, alleged that he was repeatedly housed with racist and homophobic ho·mo·pho·bi·a
