Smith v. Board of County Com'rs. of County of Lyon, 216 F.Supp.2d 1209 (D.Kan. 2002). A prisoner brought state tort tort, in law, the violation of some duty clearly set by law, not by a specific agreement between two parties, as in breach of contract.
