Earlier this month a children's panel ruled the boy should be taken away from his gran .
It was agreed the tot should be handed over to foster parents with both women getting access rights until a full custody decision is made.
But before that could happen the boy's mum was charged with shoplifting from Presto's in Kelso.
She is believed to be in Corton Vale Prison, Stirling, awaiting a court appearance.
Yesterday, the boy's 39-year-old gran, a mother of three who left her common- law husband after 16 years to set up home with her partner in East Lothian East Lothian (lō`thēən), council area (1993 est. pop. 85,640), 262 sq mi (677 sq km), and former county, SE Scotland. Under the Local Government Act of 1973, the county of East Lothian became (1975) part of the new Lothian region, , said:
"I have looked after my grandson virtually since he was born.
"I will fight all the way to convince people that he should stay with me for good."
The boy is still with his gran and her 29-year-old lover until an appeal against the children's panel decision is heard at Haddington Sheriff Court next month.
