SUPREME COURT UPHOLDS TRIMBLE COUNTY PLANT RULING

 LOUISVILLE, Ky. Oct. 20 /PRNewswire/ -- The Kentucky Supreme Court today declined to review a Kentucky Court of Appeals order overturning a lower court's order that had improperly directed Louisville Gas and Electric Company (LG&E) to refund approximately $150 million to its customers in a case
involving LG&E's Trimble County electric generating station. Last April, the appeals court ruled that a circuit court had improperly set utility rates in ordering refunds. Today's ruling allows the issue to return to the Kentucky Public Service Commission (PSC) for resolution.
 "We are pleased that today's decision will allow this issue to be finally resolved for our customers and shareholders in the appropriate forum, which is the PSC," said Victor A. Staffieri, the company's Senior Vice President and General Counsel.
 Under a 1989 agreement with the PSC, LG&E issued $11 million in refunds to its customers, in accordance with a previous PSC decision that only 75 percent of the construction costs for LG&E's Trimble County plant could be included in the utility's rate base. LG&E and the PSC agreed that proceeds from any sale of the disallowed 25 percent of the Trimble plant's capacity belonged to LG&E and its shareholders.
 A group of intervenors, including the Kentucky Attorney General and the Jefferson County Attorney, appealed that agreement to the Franklin (KY) Circuit Court. LG&E appealed the subsequent circuit court ruling to the appeals court. The intervenors petitioned the Supreme Court review of the appellate court order.
