Byline: Troy Anderson Staff Writer

Instead, the supervisors voted 3-2 - Michael D. Antonovich Michael Dennis Antonovich (born 1939 in Los Angeles, California) is a member of the Los Angeles County Board of Supervisors representing the Fifth District, which covers northern Los Angeles County, the Antelope, Santa Clarita, Pasadena, and parts of the San Fernando and San  and Don Knabe Donald R. Knabe (born October 15, 1943 in Illinois) is a member of the Los Angeles County Board of Supervisors, serving the Fourth District, a crescent shaped district that covers the coastline from Marina Del Rey southward to Long Beach, and southeastern Los Angeles County to  in opposition - to direct County Counsel Lloyd Pellman to keep the supervisors updated on the case pending the U.S. Supreme Court.

Antonovich and Knabe introduced the motion to direct county lawyers to file the brief so it would be read before the U.S. Supreme Court when it considers the case.

The U.S. 9th Circuit Court of Appeals in San Francisco San Francisco (săn frănsĭs`kō), city (1990 pop. 723,959), coextensive with San Francisco co., W Calif., on the tip of a peninsula between the Pacific Ocean and San Francisco Bay, which are connected by the strait known as the Golden  recently declared the Pledge of Allegiance as unconstitutional after a Sacramento atheist sued the Elk Grove Elk Grove can refer to:

Elk Grove has appealed the case to the U.S. Supreme Court.

Supervisor Zev Yaroslavsky Zev Yaroslavsky (born December 21, 1948) is a Los Angeles County politician. He served on the Los Angeles City Council from 1975 until 1994, when he was elected to the Los Angeles County Board of Supervisors. He was preceded in both offices by Edmund D. Edelman.  said all five supervisors support the pledge and recite it every week, but the county has no stake in this case.

``It's not an issue about 'under God' or the Pledge of Allegiance,'' Yaroslavsky said. ``It's an issue about how many amicus briefs where we don't have a direct corporate interest do we want to get involved in. It costs money every time we do it.''

The supervisors voted unanimously last July to send a letter to Elk Grove supporting an appeal and to President George W. Bush and Congress expressing the board's support of an appeal.

Knabe said the board hasn't had a problem spending hundreds of thousands of dollars filing briefs on other cases that have gone to higher courts, including one banning weapon bazaars on government property.

The county recently agreed to pay a $1.6 million settlement to the owners of Great Western Shows in return for a promise the company will never bring its gun show back to Fairplex in Pomona.

``Many schools in the county would be impacted, including our own county high school for the arts,'' Antonovich said. ``I notice that Congress had a unanimous vote in the U.S. Senate, and it would seem to me that because it does impact our county school that the pledge should stand as recited for the past 50 or 60 years.''
