 suit sent to state court

A federal judge Friday returned Brad Pitt's lawsuit against Playgirl magazine to state court, setting back the magazine's efforts to invoke a First Amendment argument for publishing the actor's nude photos.

The lawsuit was originally filed in state court and U.S. District Judge Kim Wardlaw said it can be handled more efficiently there.

Pitt sued Playgirl for publishing nude photos taken of him and then-girlfriend actress Gwyneth Paltrow frolicking outside a hotel bungalow bungalow [Indian bangla,=house], dwelling built in a style developed from that of a form of rural house in India. The original bungalow typically has one story, few rooms, and a maximum of cross drafts, with high ceilings, unusually large window and door  on a Caribbean island two years ago.

Playgirl attorney Kent Raygor argued the case should be decided in federal court so his client could invoke First Amendment rights. While it was a setback, Raygor said the same issues apply in state court.
