SIMI JOINS TRAIN SUIT RECOUPED DEATH BENEFITS SOUGHT.

 lawsuit against Moorpark over a freak train collision that killed a municipal electrician.

Simi Valley is seeking to recoup $150,000 in death benefits it paid to the family of Charles Ozal Shere, 64, who was killed in November 2003 while driving a city-owned pickup truck.

``He was a valued member of our Simi Valley family,'' said City Councilman Glen Becerra. ``This was a tragedy. Not only did the Shere family suffer a great loss, but the city suffered the loss of a highly respected employee that will be greatly missed.''

Shere's wife, Paulette, and their children have filed an $8 million lawsuit against Moorpark and several other parties, claiming the railroad crossing at West Los Angeles

Moorpark is trying to resolve the issue out of court, officials said.

The suit is against the city of Moorpark, the county, the state Department of Transportation, Union Pacific Corp., and Arturo Manuel Bacilio, the driver of the Ford Explorer involved in the initial crash. A trial is scheduled to begin June 20.

Andrew Shapiro, the Shere family's lawyer, declined to comment.
