PLAX PATENT INFRINGEMENT AND TRADE DRESS SUIT
NEW YORK, Nov. 11 /PRNewswire/ -- Pfizer Inc (NYSE: PFE) announced today a settlement in a suit against L. Perrigo Company of Allegan, Mich., that protects its innovative Plax pre-brushing dental rinse from product imitations.
Under the settlement, Perrigo will take action to assure that its oral rinses do not copy the shape of the Plax bottle, its label or its formula. The agreement incorporates the terms of an earlier preliminary injunction by a U.S. Federal District Court.
"This agreement sets a precedent for Pfizer's efforts to preserve the integrity of Plax and represents an initial action to protect our innovative brand from being copied by private label products," said Rom Cartwright, vice president of Pfizer Oral Care division.
"This serves notice that Pfizer will remain vigilant in protecting its product rights and will take appropriate action whenever those rights are violated," Cartwright said.
Prior to the completion of the settlement, Perrigo made changes in its formula as ultimately required by the agreement, Pfizer said.
