Review editor's note.I am pleased to present the 2001 Ninth Circuit Environmental Review. Providing a convenient resource for the scholar as well as the practitioner, this issue presents categorically organized and indexed summaries of the environmental and natural resources cases decided by the Ninth Circuit Court of Appeals in 2000-2001. This reference is the product of a year of hard work by exceptionally dedicated and capable members of the Ninth Circuit Review. Additionally, two student members of the Review have contributed insightful Chapters on some of the more challenging environmental and natural resources issues facing the Ninth Circuit. Ms. Laura Hartt uses Pacific Coast Federation of Fishermen's Association v. NMFS as a springboard for a comprehensive analysis of logging's adverse cumulative effects on protected species and the legal tools available to environmental advocates for challenging logging practice based on these effects. Mr. David Foster explores the controversy over the continuing violations doctrine under the Clean Water Act--an issue yet to be resolved by the Ninth Circuit--and its importance to the protection of wetlands. I applaud this year's Review members for their hard work, diligence, and patience. The four members of the Review were selected from Environmental Law applicants for their exceptional writing skill, and their skill made my role in this effort pleasant and easy. The excellence of their work is especially commendable given that they were required to analyze and summarize appellate cases in addition to their responsibilities as first-year members of Environmental Law. Legal scholars and practitioners alike will greatly benefit from their effort and dedication. Erik C. Swallow Ninth Circuit Review Editor |
