A sample contract for relocation for Nettie Samaritan

A famous American television character once said, "Trust No One." Fox Mulder of the X-files was right, and nowhere is that more applicable then when dealing with ornery old Uncle Horace Grump. Never go into business with family without a binding contract in place.
Background
Nettie Samaritan received a telegram from her uncle, Horace Grump, an 80-year-old cantankerous cattle rancher who injured himself in a bad horse fall. He requested that she come to Arizona to manage the ranch for him, as she is his only living relative. He indicated that she would be compensated and remembered in his will.
Nettie Samaritan is considering assisting her uncle in Bisbee, Arizona in the undertaking of his ranch. She is presently located in Fairbanks, AK and would have to relocate to Arizona. She is currently enrolled in graduate nursing school and has a wide circle of friends. She would be leaving a very comfortable situation to enter into unknown territory with no friends or social activities. Although the well being of her uncle is a major concern, Nettie has to take into consideration all that she has established for herself in Fairbanks, Alaska before committing to her uncle.
After serious consideration, Nettie has agreed to assist her uncle in Arizona. In order to commit to him, she feels as if she needs some legal assurances that Uncle Horace will deliver on his vague promises. Nettie has had the following contract drafted for her Uncle Horace to sign. She will need legal acknowledgement of his commitment to her before she will transfer Nursing schools or make moving arrangements.

Contract Drafting Date August 1, 2001
Offer expires August 15, 2001

For the purpose of this contract, Nettie will herein be referred to as the Offerer. Her uncle, Horace Grump will herein be referred to as the Offeree.
Name of Offerer
Nettie Samaritan, 555 Gold Digger Drive, Fairbanks, Alaska.
Name of Offeree
Horace Grump, 123 Hanging by a Thread Lane, Bisbee, Arizona.

Length of Term of Contract
The contract starts on September 1, 2001 and the obligation term continues for a period of five years. The first 180-days of this contract is a trial period during which time either party may terminate the contract for any reason. After the initial trial period, both parties promise to act in good faith to the agreed upon terms and conditions contained within this contract. The contract immediately terminates upon death or mental incapacity of either party.

Continuation of Contract
At the end of the five-year contract term, the contract will renew on an annual basis automatically, unless either party gives 60 days advance written notice to terminate the contract. The Offerer will receive an annual cost of living increase at a rate of five percent per year for each additional annual renewal term.

Discharge of Contract
The contract can only be discharged by mutual agreement of both parties. Should the contract need to be discharged by the parties, the Offerer agrees to relinquish her 10 percent equity in the ranch business. The Offeree agrees to pay a nominal fee of $1.00 to the Offerer.

Terms and Conditions
The contract is not enforceable if the Offeree does not have legal counsel discuss and approve the enclosed contract terms. See Addendum A. Offerer stipulates that Offeree must submit to and pass an independent evaluation to ensure the Offeree's ability to contract. See Addendum B.
Prior to the effective date of this contract, the Offeree agrees to provide to the Offerer a current title search on the property to prove clear ownership.

Consideration
Offeree will pay moving expenses of Offerer to relocate to Bisbee, Arizona. Offerer will submit three written quotes for moving expenses and the lowest reasonable quote will be selected. Offeree will pay for a one-way coach class ticket for Offerer. The moving expenses will include the transportation of Offerer's vehicle to be towed with the household goods.
Offeree will pay living expenses to include monthly Room and Board. In addition, the Offeree will agree to cover educational expenses to continue Graduate Nursing School. Expenses will include tuition, books and lab fees. Offeree will also pay for Offerer's health and dental insurance benefits for the term of the contract to also include additional renewal years.
The Offerer will receive an annual salary of $45,000 to be paid bi-monthly for managing the ranch and household. In addition, the Offerer will receive a 10 percent equity interest of the business to include the land, livestock, permanent structures, motor vehicles and any articles related to the cattle business.
Management of the ranch and household will include accounting and staffing responsibilities as well as the day-to-day operations. The Offerer will receive annual paid vacation of 10 calendar days to be used at her discretion.
The Offerer will receive five round trip coach airline tickets to Fairbanks, Alaska, one ticket for each year of the contract term.
In the event of the Offeree's death during the contract period, the title to the ranch, the business and associated property will revert to the Offerer as long as she agrees to reside on the property and continues to maintain and manage the ranch as a family business.













Acceptance of Terms
BY SIGNING THIS OFFER TO CONTRACT, EACH PARTY AGREES THAT THEY HAVE READ AND UNDERSTAND ALL OF THE TERMS AND CONDITIONS IN THIS AGREEMENT. THE TERMS OF THIS CONTRACT SUPERSEDES ANY WILL AND TESTAMENT FOR HORACE GRUMP REGARDING THE DISPOSITION OF ASSETS AS LISTED IN SCHEDULE A.

Conclusion
Horace Grump has asked a lot of his niece to give up her life and come help manage his ranch. For her to consider such a risk she needs to protect herself from possible failure on his part to make good on his promises. Since she has considered the move to be a beneficial one in the end, she is willing to move to Arizona and manage the ranch as long as she can continue her education. The five-year term is a long commitment for Nettie to make, but she feels that if Uncle Horace agrees to all of her requests, a five-year commitment is fair enough for her to give to him. She realizes that the five-year term also protects Uncle Horace from her leaving without notice. He is taking a big chance on her and will be investing a lot of time and money into her relocation and training.
Nettie's long debate on whether to move or not was a difficult decision for her to make. She will be giving up her school, social circle of friends and activities. It is only fair that she should be compensated for her commitment in this endeavor to manage the ranch. After all, he did contact her to come to Arizona to help manage the ranch. Why shouldn't she receive funds from him to cover her moving expenses? Financial assistance on his part to help Nettie get to Arizona will only prove to her how serious Uncle Horace is in his offer.
Nettie feels a little awkward in asking her uncle to agree to the capacity to contract clause, as she does not want to insult him. She was taught to respect her elders, but the fact remains that she is giving up a lot to relocate where she knows no one but him. She wants to make sure that he is good on his word and that she will not be left with his debts or any financial business problems in the process. Nettie agrees that the attorney evaluation will help her Uncle Horace understand the relocation process and what is involved the next five years. The attorney evaluation will give her peace of mind knowing that this will be a safe move for her and will minimize the risk for both her and Uncle Horace.

On behalf of Horace Grump, I, Herman Feather, ESQ., assert that I have read, evaluated and advised the Offeree, Horace Grump on the terms and conditions of the contract presented to him by the Offerer, Nettie Samaritan, on this day August 15, 2001.
