Rasul v. Bush Rasul v. Bush, 542 U.S. 466 (2004), is a landmark United States Supreme Court decision establishing that the U.S. court system has the authority to decide whether foreign nationals (non-U.S. citizens) held in Guantanamo Bay were rightfully imprisoned. , 215 F.Supp.2d 55 (D.D.C. 2002). The district court dismissed the actions, holding that the cases could be considered only as petitions for writs of habeas corpus, and finding that aliens held by the United States outside the sovereign territory of the United States could not use U.S. courts to pursue petitions for habeas relief.
