A grand jury in August indicted INDICTED, practice. When a man is accused by a bill of indictment preferred by a grand jury, he is said to be indicted. Anait Ano Msryan, 14, Rafael Gevorgyan, 15, and Karen Terteryan, 18, on charges of murder, attempted murder and street gang terrorism. The minors face trial in adult court under Proposition 21, a statewide initiative that requires treating murder suspects 14 and older as adults. If found guilty in adult court, juveniles could face stricter sentences. Fidler said the drafters of the proposition, passed by voters in March, did not, however, address the issue of indicting juveniles. Because defense attorneys did not attend the secret grand jury proceeding, they did not get the chance to argue before trial that their clients belong in Juvenile Court juvenile court Special court handling problems of delinquent, neglected, or abused children. Two types of cases are processed by a juvenile court: civil matters, often concerning care of an abandoned or impoverished child, and criminal matters, arising from antisocial . So Fidler suspended proceedings and will send the case back to Juvenile Court - which defense attorneys say is where the case belongs. Gevorgyan's attorney, Andrew Flier, said the D.A.'s decision to appeal was expected. ``Once again, this is a political move and the D.A.'s Office is just prolonging the inevitable,'' that his client is innocent and not a gang member, he said. Prosecutors identified Msryan, Gevorgyan and Terteryan as Armenian gang members who killed Aguirre on May 5. The high school senior jumped to the aid of acquaintance Jimmy Orozco, a Latino gang member, whom prosecutors say flashed rival gang signs. Aguirre, who was stabbed and beaten, was not in a gang. The three teen defendants are being held at Eastlake Juvenile Hall on $1 million bail. A hearing is set for Sept. 28. |
