ROURKE WAS VICTIM OF A FAULTY BREATHALYZER


MICKEY ROURKE has been handed an early Christmas gift from Miami Beach police officials in Florida - they've confirmed the Breathalyzer test the actor failed a month ago (Nov07) was incorrect.

The Angel Heart star was pulled over by cops after they spotted him weaving all over the road on a scooter.

They asked the actor to blow into their Breathalyzer - to determine if he was too drunk to drive. The test suggested Rourke was just over the legal limit.

But now the authorities have revealed the Breathalyzer machine that was used was broken.

A second machine used later showed the actor was just under the legal limit.

But Miami Beach's District Attorney still has to officially drop DUI charges against the actor, according to TMZ.com.
