 ROCHESTER, N.Y., April 2 /PRNewswire/ -- On March 30, 1992 the


Administrative Law Judge (ALJ) presiding in the Company's current rate proceedings before the New York State Public Service Commission (PSC) released his recommended decision. The ALJ recommended an increase of $21.5 million (3.4 percent) in electric rates, $11.9 million (4.0 percent) in gas rates and a return on equity of 10.7 percent. The Company's current request is for an increase in electric rates of $38.2 million (6.1 percent), an increase in gas rates of $15.1 million (5.0 percent) and a return on equity of 12.5 percent.
 The ALJ also agreed with the recommendation of the PSC staff that $8.2 million of certain storm damage repair costs relating to the March 1991 ice storm be disallowed for rate making purposes. The Company had requested recovery of deferred storm related costs of approximately $36.4 million. The Company believes those costs to be prudent and,therefore, recoverable in rates; but, it cannot predict what action the PSC may ultimately take regarding their recovery. A decision by the PSC is expected in June 1992.
 If the PSC agrees with the recommendation to disallow $8.2 million of storm related costs, the Company would be required to charge that amount against earnings, which would reduce earnings per share for 1992 by approximately $.17. The Company believes that the reduction in earnings per share by itself will not affect its ability to maintain the current dividend level, but the payment of future dividends is dependent upon several factors including future earnings, its financial requirements and other factors.
