RFI GETS 120-DAY DEADLINE FROM CITY DEVELOPERS GIVEN CHANCE TO COMPLY.

 on Tuesday ruled that the company trying to turn the former Bermite explosives factory into a subdivision has 120 days to comply with the site's development agreement.

 wants to build Porta Bella - which would include 2,911 homes, a road network and commercial properties - on 996 acres in the center of the city.

To meet the commission's demands, the company must comply with all future performance reviews in a timely manner and make an unequivocal and unconditional demand that the city of Santa Clarita be added to RFI's insurance policy.

In addition, RFI must provide the commissioners with feedback from state officials that shows progress is being made in the cleanup of the site while ending the enforcement action being considered by the Attorney General's Office.

Also, the company must allow the city to use the commuter train station property as long as the development agreement is in place, offer the city an option to lease the site and dismiss the lawsuit it filed against Santa Clarita over the Metrolink station.

The company has the right to appeal the decision to the Santa Clarita City Council.

RFI representatives will return to the commission with a detailed schedule and strategy for resolving the company's problems with the state Department of Toxic Substances Control, the lead agency overseeing the cleanup.

``I assure the commission that this company will work diligently to achieve the letter and the spirit of these remedies,'' said RFI attorney Ivor Samson.
