Sofsky's testimony came on the second day in the trial of Randy Valli, the singer's wife, who is charged with misdemeanor battery for slapping the restaurant owner during an argument at the restaurant in the fall.

Sofsky said she did not recognize Avalon or Valli, who between them topped the charts with hits including, ``Venus,'' ``Walk Like a Man'' and ``Big Girls Don't Cry.'' When asked whether she knew of Frankie Valli, Sofsky misheard the name and deferred answering, apparently further angering the two couples.

The Oct. 7 incident escalated, with the celebrity diners Diners can mean:

 showering Sofsky with obscenities and refusing to leave, she said. Avalon's wife, Kay, threatened to sue and promised they would own the restaurant, Sofsky said.

The two couples left without paying the $178 bill. The next day, Frankie Avalon sent a note apologizing for ``the incident'' and a check for $200.

Under cross-examination by defense attorney Chuck Samonsky, Sofsky conceded that she was so angry that she contemplated a lawsuit. Samonsky grilled Sofsky about her motives.

``We're not suing them civilly,'' said an upset Sofsky. ``I don't want their money.''

Samonsky also asked Sofsky about quotes attributed to her in tabloid magazines. Although she and several restaurant staffers posed for a tabloid photo, Sofsky said she did so only to get the tabloids to stop harassing her.

``Did you smile for the pictures?'' Samonsky asked.

``Probably,'' Sofsky replied.

``Did you give statements to these tabloids?

``I don't recall . . . I asked them to leave,'' Sofsky said. ``They came to our home. They came to our restaurant. If they took this picture (I hoped) they would please leave us alone.''

The trial is expected to continue into next week.
