Stewart and Lynda Resnick, owners of Roll International Corp., have filed a $25 million malicious prosecution An action for damages brought by one against whom a civil suit or criminal proceeding has been unsuccessfully commenced without Probable Cause and for a purpose other than that of bringing the alleged offender to justice.  claim against the estate of Princess Diana and a memorial fund established in her name.

The Resnicks, who with an estimated net worth of $900 million are among the wealthiest people in L.A., filed the suit on behalf of Roll's Franklin Mint subsidiary. The suit, filed on Nov. 15 in Los Angeles Superior Court, is the latest salvo in the battle between the sellers of Diana collectibles.

It received money set aside by Diana's will, contributions by her former husband, The Prince of Wales, donations by the public, and the proceeds from Elton John's new  sued the Franklin Mint in 1998, claiming it sold products depicting Diana that may have been confused with the 20 products endorsed by the fund. The Franklin Mint had been selling products related to Diana, who died in a car crash in 1997, since her 1981 marriage to Prince Charles.

The Mint won that case in 2000 and was awarded $2.3 million in legal fees.

 that the courts ultimately threw out the case and characterized many of the Memorial Fund's allegations as absurd,' 'groundless' and 'unreasonable,' the Memorial Fund and their trial lawyers need to be held accountable for their actions," said a Franklin Mint statement. "It is for this reason that the Mint's owners decided to bring their action for malicious prosecution."

The Franklin Mint intends to donate to charity any damage awards exceeding the costs of the suit, according to the statement.
