Plane conspiracy case SC directs AG to present full record.
ISLAMABAD, June 08, 2009 (Balochistan Times) -- The Supreme Court
adjourned on Monday the hearing of plane conspiracy case against former
Prime Minister Nawaz Sharif till Tuesday (today) and directed the Sindh
advocate general to present full record of the case. A larger bench of
the court headed by Justice Tasadduq Hussain Jilani was hearing the
case. Justice Nasir-ul-Mulk, Justice Sheikh Hakim Ali, Justice Musa K.
Leghari and Justice Ghulam Rabbani are other members of the bench.
During hearing on Monday, the advocate general Punjab Khwaja Haris in
his arguments told the court that the plane conspiracy against Nawaz
Sharif was based on lies and only allegations. On that the court asked
the Sindh AG Yousuf Safari why the record of Nawaz conviction was not
presented before the court, then he told the court that the concerned
record on trial court and High Court decisions has been lost, on which
the court directed AG Sindh and Prosecutor General Shahadat to present
record at any cost. The court also directed the Sindh government to
submit its statement over its failure to present full record of plane
conspiracy case and tell the court that when it will present the record
along with pardon. Khawaja Haris informed the court that according to articles 9 and 4 regarding basic human rights, the affected party is
deserved to move court and get justice in case of delay after decision
of the case because Nawaz Sharif was forcibly sent to exile along with
family and deprived him of basic rights granted to him under article 3
and 4 of the constitution and not allowed to return the country and in
such condition how he could pursue the case. He told the court that the
terrorism case against Nawaz Sharif in plane conspiracy case was
baseless because being the prime minister he had the powers, which could
not be challenged, adding, the then judges made false cases against
Nawaz Sharif to keep him out of the government after that the court
adjourned hearting till Tuesday (today). It may be mentioned here that
seven persons were nominated in the plane conspiracy case, including
Nawaz Sharif, Saif-ur-Rehman and chairman of Civil Aviation Authority.
The trial court had quitted six out of seven after initial hearing and
awarded 25-years imprisonment to Nawaz Sharif, however, the High Court
while contradicting to the decision of the trial court said that
additional punishment has been awarded on little proofs and then the
High Court had reduced the punishment to 25-years only, which was
challenged the PML-N few days ago.
