 keep their files for years and years, renting storage spaces keep them in. When an attorney removes a file, he or she is accountable for its whereabouts.

Also, this nonsense that she only worked on the case a limited amount: The file shows about one-third of the billing hours to her plus about 14 meetings. The other two-thirds of the billing hours were with a junior member of the firm. In the law business the senior attorney never does the bulk of the billing hours. The junior people do the busy work. But the senior partner is the one who controls.

It would be interesting to test the papers to see if they were originated years ago or recently. If recently, it would prove the deception theory being circulated by the anti-Clinton movement was correct. If they were originated a number of years ago, that could close the issue.

Pipeline editorial rebutted

Rarely has a Daily News editorial been so off the track in both fact and analysis as it was in its Jan. 29 editorial regarding the proposed Pacific Oil Pipeline Project, "City Hall railroad job."

The council took the wise, prudent and appropriate step of alerting the relevant city departments, including the city attorney, that they will be expected to scrutinize this enormous and controversial project to assure its compliance with environmental policies. This action is entirely justified. Even so, I called for the motion to go before the relevant committees to assure its appropriateness. The Daily News somehow missed that fact as well.

Second, there are very real concerns of public safety. The Department of Water and Power has stated that the proposed crude-oil pipeline would place over 75 percent of the city's water supply in danger in the event of an earthquake or other major disaster. The danger is in placing this crude oil pipeline through L.A.'s "lifeline" corridor - the Newhall Pass Newhall Pass is a mountain pass in Los Angeles County, California, USA. Historically called San Fernando Pass and Fremont Pass, it separates the Santa Susana Mountains from the San Gabriel Mountains. . In the event of a pipeline rupture, L.A.'s water, Metrolink, power lines and the Golden State Freeway The Golden State Freeway is a north-south freeway running through Kern County and Los Angeles County, California. Originally built as U.S. Highway 99, it was re-signed as Interstate 5 in 1964.  would be in jeopardy of being cut off.

I can't think of an unfriendlier place for business than in a city that places greater importance on concerns over "wrong messages" to the business community than to the public safety of businesses and residents.

Fourth, there is an alternative that should be fully explored. The Cajon-EPTC project proposal, which includes the use of an already existing pipeline, was not been addressed in the draft environmental report when it was circulated last year.

Lastly, the communities through which the pipeline would pass are poor, working-class minority communities. And it doesn't just affect communities in my district, but it affects poor, working-class communities throughout the city. Siting the pipeline in these areas continues the historic practice of "environmental injustice," that is, locating undesirable facilities in the communities least able to defend themselves. It is high time that this practice cease.

The City Council did nothing more than preserve our options in its recent action on the Pacific Pipeline. Since the project was first proposed, the city has exhausted virtually every administrative action possible with the state Public Utilities Commission and U.S. Forest Service, creating an extensive paper trail of environmental concerns.

Decisions must be based on the merits on the merits adj. referring to a judgment, decision or ruling of a court based upon the facts presented in evidence and the law applied to that evidence. A judge decides a case "on the merits" when he/she bases the decision on the fundamental issues and considers  of the environmental documentation, hence our motivation in the city to get it right. It also explains why Pacific Pipeline and its army of lobbyists are so upset that the council demonstrated some backbone. These are the same oil industry lobbyists that fought the council's attempt to hire outside experts on pipeline construction and socio-economic impacts to help us better understand the project.

This was no quickie vote. Our actions were limited exclusively to the issue of the environmental document and doing what is necessary to get it right. - Mike Hernandez

Thank you for your Jan. 22 article regarding the proposed Pacific Pipeline ("Disputed Valley pipeline plan awaits OK"). It points out very real concerns about the safety of a trans-Valley oil pipeline at a time when communities are justifiably nervous about invasive new commercial projects in their midst.

The oil pipeline is offered by a Colorado-based limited partnership 80 percent owned by a real estate interest (The Anschutz Co.), and 20 percent owned by Chevron, Unocal and Texaco. Their plan requires 132 miles of new pipeline construction that bisects the city of Los Angeles

Let's remember that while pipelines are a safe and viable method for transporting oil, there are prominent differences between the two current plans for a new pipeline infrastructure.

Courts go too far

We are now witnessing the reality of who really runs this country - the courts. They have taken over legislation and are making, enacting and ruling on laws while trampling on the rights of Joe Public.

The first foot-in-your-eye decision was made by a federal district judge, Mariane Pfaelzer, who decreed that Proposition 187 violated the Constitution, even though it was passed by 60 percent of the electorate as a state initiative. Here was law-making as its boldest.

The second thrust was the U.S. Supreme Court's rejection of Gov. Pete Wilson's challenge to the Motor-Voter Bill, which allows one to register to vote while obtaining a derivers license and no questions asked.
