PROSECUTOR CALLS CASE SHIFT PAYBACK BY DA.

D'Agostino said she was told to turn over her Rogers file last month because Garcetti's office had identified the prosecution as a ``major crimes case.''

Rogers, 34, was sentenced to be executed last month for stabbing to death a woman in a Tampa, Fla., motel bathtub in 1995.

Chief Deputy District Attorney Sandra Buttitta issued a brief statement stating that the case was reassigned to the major crimes division, which handles high-profile and complex criminal cases, as part of a ``normal evaluation process.''

But D'Agostino noted that the reassignment came just days after she told Garcetti that it appeared likely that Rogers would stand trial in California. Citing unidentified sources, D'Agostino said that Florida has informally agreed not to oppose Rogers' extradition.

``Garcetti decided there was no way he was going to leave me on one of the highest-profile cases in the office, with all the attendant media coverage,'' she said.

D'Agostino and her attorney, Gloria Allred Gloria Rachel Allred (born Gloria Rachel Bloom on July 3, 1941) is an American lawyer and radio talk show host. She is also the mother of Court TV hostess Lisa Bloom. , appeared at a grievance hearing Wednesday afternoon, seeking reinstatement on the case and an apology. The office has five days to respond, the prosecutor said.

D'Agostino earned the sobriquet ``Dragon Lady'' during a murder trial many years ago, and has a 99 percent conviction rate during 20 years as a prosecutor, she said. Her only not-guilty verdict came during the ``Twilight Zone'' case, she added.

She ran unsuccessfully against District Attorney Ira Reiner Ira Reiner was Los Angeles City Controller from 1977 to 1981, and was City Attorney from 1981 to 1984, both times being succeeded by James Hahn. He was the Los Angeles County District Attorney from 1984 to 1992. , Garcetti's predecessor.

D'Agostino's accusations are the latest from several prosecutors who claim that they were the victims of political payback by Garcetti.
