The measure involves voluntary participation by the drug companies and, for a $15 application fee, would provide discounts to seniors and uninsured Californians earning up to 300 percent of the poverty level.

That means it would apply to individuals earning $29,000 a year, or a family of four earning $58,000 or less.

 passed and provide real discounts to uninsured, low-income people,'' said Denise Davis, spokeswoman for the Yes on 78/No on 79 campaign.

Proponents say Proposition 78 is an improved version of a program operating successfully in Ohio that delivers average discounts of 31 percent, and note that despite the program being voluntary among drug companies, every major prescription drug maker participates in the Ohio program.

The pharmaceutical industry has amassed more than $80 million for its dual Yes on 78/No on 79 campaigns.

Davis noted that the industry does not need an incentive to comply with the Proposition 78 program because it supports it.

``The companies have pledged their support publicly,'' Davis said. ``They're heavily invested in this, they want it to work, they want it to be a model for success for the rest of the nation.''
