PLEA DELAYED FOR DRIVER IN CHILD'S DEATH; MOM'S ROOMMATE FACES MURDER CHARGE.

``Why she did what she did - I don't have the answer to that one. I can't speculate on that,'' Deputy District Attorney Meredith Rust said after Gutierrez's court appearance. ``It's a tremendous tragedy when you've got a little 8-year-old girl who suddenly dies. Whether it's completely accidental or whether it is murder, either way this is a tragedy.''

Relatives of the girl attended the court hearing in Antelope Municipal Court and later, in an emotional scene, talked with news reporters in the court hallway.

The arraignment was postponed until Dec. 30 because Gutierrez's attorney, Deputy Public Defender public defender, governmental official who represents indigent persons accused of crime. U.S. Supreme Court decisions expanding the right to counsel to pretrial proceedings and holding that a person cannot be sentenced to even one day in jail unless a lawyer was  Mitch Bruckner, has not received all information on the case, including the report or tape recording of a statement his client gave to detectives.

``This is a very horrible case. All legal issues aside, an 8-year-old died an extremely tragic death,'' Bruckner said.

The defendant and the child's mother had argued about whether the defendant was too drunk to drive home from a birthday party, detectives said, and the mother decided to walk with Sara and Sara's 7-year-old brother.

The defendant drove slowly beside the three walkers, tried to persuade them to get into the car and got angry when they refused, deputies said. She drove off but soon turned back and drove the car directly at the three, deputies said.
