PENNSYLVANIA LIQUOR CONTROL BOARD TAKES ACTION
TO MAKE PROSECUTION OF UNDERAGE DRINKING EASIER
HARRISBURG, Pa., Aug. 10 /PRNewswire/ -- The Pennsylvania Liquor Control Board has taken action which it said it hopes will make it easier for law enforcement officials to prosecute underage drinking cases.
The agency published a list in the Aug. 8, 1992, edition of the Pennsylvania Bulletin of the 576 malt beverage brands registered for sale in the state. The list contains only alcoholic beers, those with one-half of 1 percent alcohol or more.
The board said it hopes the list will put to rest concerns by law enforcement officials following a recent Pennsylvania Supreme Court decision. The decision stated that in a prosecution for underage possession of beer the prosecutors must prove that the substance was actually beer containing alcohol. Since manufacturers register their respective brands as beer containing more than .5 percent alcohol, this information will be conclusive proof of that issue.
The Pennsylvania Bulletin is the official publication for Pennsylvania government notices. The PLCB is publishing the contents of these public records because courts and attorneys recognize the Pennsylvania Bulletin as an authoritative source in other types of prosecutions.
The agency said it hopes the list will help law enforcement by clarifying what constitutes an alcoholic beverage.
