Also named in the lawsuit is Tyrone Stewart, the drunk driver who crossed into oncoming traffic and slammed into Patricia Schonert's car, killing her instantly. Stewart is serving a 10-year prison sentence for her death.

Schonert's attorney Robert Francavilla declined Tuesday to comment.

City Manager George Caravalho said the newly widened road was safe, but declined to elaborate on specific claims in the lawsuit pending court hearings.

``It's a sad situation,'' Caravalho said. ``We have to be sensitive to the guy who lost his wife, but it's another example of going after the deep pocket. Clearly the guy crossed the center line and caused the accident. Why should the taxpayers pay for that?''

Schonert filed the lawsuit on behalf of himself as well as Patricia Schonert's two children and the two the couple had together.

All four children have been living with a relative after Schonert's arrest on charges of having sex with a female relative in the months after his wife's death. He pleaded no contest Monday to three felonies and is scheduled for a 90-day evaluation to determine his sentence.

The lawsuit was filed Oct. 3.
