Owners are facing jail after worker's death.

 construction company with a history of safety violations are facing jail after admitting their liability in the tragic death of a worker.

Metla Construction owners pleaded to federal charges associated with the death of Mahamadou Jabbie who fell 60-feet to his death from shabby scaffolding while waterproofing an apartment building roof in 2005.

"It was a tragic case because the government was clearly trying to tell the employer what he was doing wrong and he didn't react.

Bhatti faces a maximum of six months jail time and a $10,000 fine. Alamgir faces five years jail time and a $250,000 fine. Though construction related deaths have been steadily rising over the years, few cases in which law violation is a factor are prosecuted in criminal court.

"It is difficult because it is a time consuming process," said Mendelson. "It takes time to establish the evidence beyond a reasonable doubt. I could have easily done another 20 inspections that would have resulted in [issuing] more violations in the time it took me to put together everything for this criminal proceeding."
