Orthovita wins patent dispute.


MALVERN, Pa.--(BUSINESS WIRE)--Sept. 18, 1995--Orthovita Inc., Malvern manufacturer of bone growth materials, announced Monday that the United States Patent and Trademark Office The United States Patent and Trademark Office (PTO or USPTO) is an agency in the United States Department of Commerce that provides patent protection to inventors and businesses for their inventions, and trademark registration for product and intellectual property  has stated that it will issue a Reexamination re·ex·am·ine also re-ex·am·ine

US Biomaterials distributes its own grafting material and asked the U.S. Patent Office to institute a reexamination challenge to Orthovita's patent. US Biomaterials argued that the '106 patent was invalid in view of a patent said to be controlled and used by US Biomaterials. However, the U.S. Patent Office disagreed and upheld the validity of all claims of the Orthovita patent.
