In addition to the disease compensation program, the settlement includes money for ongoing medical evaluation of women with implants and for implant removal. It will also compensate women whose implants have ruptured but who are not ill. The pact includes safety valves for both plaintiffs and defendants. Women may choose to bypass the settlement and proceed to trial; however, if a defendant believes too many women have taken this route, the company may pull out of the agreement. Likewise, attorneys for the class may withdraw their clients as a group if, in their view, a defendant's withdrawal effectively sinks the agreement. Pointer has scheduled a formal fairness hearing on the settlement for August 18, after which he will decide whether to give it his final approval. |
