The three judges disagreed with the father's contention that he had agreed that his sons were in need of protection and claimed that he had signed a statement of fact under duress duress (dy`rĭs, d`–, d . At another point, the father claimed that he was not in court and did not realize that a custody order had been issued by the Superior Court of Justice judge. The judges pointed out that he had legal representation throughout the process.

The father claimed that the judge, W.P. Somers, had made errors and was biased. The agency responded that Justice Somers' errors were irrelevant and the Appeal court agreed that they were not material in this case.

Costs in the amount of $5,454.11 were awarded to the Jewish Family and Child Service. P.B. v. Jewish Family and Child Services
