 OUSTED AREA D SUPERINTENDENT SUES DETROIT SCHOOL BOARD
 DETROIT, June 30 /PRNewswire/ -- Benjamin Bernoudy, removed as


superintendent of Area D of the Detroit School District, sued the Detroit School Board today alleging that non-renewal of his contract was "arbitrary and capricious." The suit was filed in the Wayne County Circuit Court.
 "Mr. Bernoudy has served with distinction and loyalty," the suit alleges. "He has carried out his assignment as Area D superintendent with the competence and dedication required of a person holding such a position. He has never been the object of a critical appraisal of his work. He has not been warned about sub-standard performance, inadequate work, failure to meet goals, or refusal to carry out policy of the district," the complaint recites. Despite the total absence of any prior criticism of his work, Bernoudy was removed for an inadequate "working relationship" with the board and the general superintendent.
 The non-renewal is challenged as being "without a rational basis in fact," meaning that there are simply no reasons for the action. A circuit judge has authority to reinstate an employee who is removed without a valid reason.
 The suit does not seek a specified sum of damages, but asks that Bernoudy be reinstated as Area D superintendent, be made whole for any sums lost as a result of the demotion, that his personnel file be cleared of all references to the action, and that his attorney fees and litigation expenses be paid.
 The suit was filed by Mark H. Cousens, Bernoudy's attorney.
