OGNER NAMES RUSNAK IN COURT PETITION.

The petition was filed Oct. 17 on behalf of Ogner in U.S. bankruptcy court bankruptcy court n. the specialized Federal court in which bankruptcy matters under the Federal Bankruptcy Act are conducted. There are several bankruptcy courts in each state, and each one's territory covers several counties.  for the Central District of California. Involuntary bankruptcy is filed by a creditor against his debtor.

It names Rusnak Studio Vehicles Inc., a one-time car brokerage company that catered to many of Hollywood's top motion picture studios and television production companies, as the sole defendant in a claim amounting to about $110,000.

Rusnak Studio Vehicles closed its operations in 1997.

``We suspect that avoidable (financial) transfers may have been made when Rusnak terminated its studio vehicle rental business,'' said Gregory S. Abrams, an attorney with A.S.K. Financial in Tarzana that represents Ogner Motorcars.

Paul Rusnak, the current owner and president of Rusnak Pasadena on East Colorado Boulevard Colorado Boulevard (or Colorado Street) is a major east-west street in Southern California, United States. Rusnak, who has been looking to relocate his dealership out of Pasadena for the past several years, dismissed the petition as ludicrous.

``It's not even worth the conversation,'' Rusnak said. ``We're in litigation An action brought in court to enforce a particular right. The act or process of bringing a lawsuit in and of itself; a judicial contest; any dispute.

Rusnak's attorney, Bruce Palumbo of Ammirato & Palumbo LLP LLP - Lower Layer Protocol  in Pasadena, called the petition an attempt to try to embarrass his client.

``It's preposterous and an abusive process in my opinion,'' Palumbo said while confirming his client had been the sole shareholder in Rusnak Studio Vehicles. ``What (Ogner Motorcars) is doing really is despicable.''

A car dealership or vehicle local distribution is a business that sells new cars and/or used cars at the retail level, based on a dealership contract with an automaker or
 that loans cars, such as Ferraris and Porsches, to car brokers that sometimes rent them for use in commercials, movies and television shows.

``(Rusnak Studio Vehicles) had assets, then they no longer had assets,'' said Ogner's attorney. ``They won't identify or explain what happened to their assets, so we filed this as a means to determining what happened.''

Abrams said although his client could have taken the same lawsuit to a state court, a trustee who would investigate all business transactions can only be appointed through a bankruptcy court.

``When you become a trustee, it's as if you take over ownership of the business'' he said. ``All books and records of the company belong to the trustee.''

Lawyers representing the former Rusnak Studio Vehicles have 20 days from the filing date to oppose the petition. Palumbo said his law firm is currently studying their options.

Rusnak Pasadena sells and leases high-end cars including Audis, Mercedes-Benzes, Jaguars, Porsches and Rolls-Royces.

In June 1999, Ogner Motorcars was awarded $108,871.75 in a breach of contract action against Rusnak Studio Vehicles in Los Angeles Los Angeles (lôs ăn`jələs, lŏs, ăn`jəlēz'), city (1990 pop. 3,485,398), seat of Los Angeles co., S Calif.; inc. 1850.  Superior Court.

Rusnak, in turn, appealed the judgment, which is still in the judicial process.

The company's attorney, Palumbo, said the involuntary bankruptcy petition puts a stop to the appeal process.

``That's why (Ogner Motorcars Inc.) did it,'' he said. ``So the court, where they filed, and the appellate system can't do its job.''
