To: All persons in the United States who purchased Holland House Red Cooking Wine, a product manufactured, marketed and distributed by Cadbury Schweppes, PLC and/or Cadbury Schweppes, Inc., (collectively referred to as "Cadbury") before March 6, 1996.
Please read this notice carefully and in its entirety. Your rights will be affected by legal proceedings in this litigation.
Notice is hereby given, pursuant to Rule 908 of the New York Civil Practice Law and Rules and in accordance with the Order of the Honorable Barbara R. Kapnick of The Supreme Court of the State of New York, County of New York, that the plaintiff in the above entitled action ("the Action") seeks to voluntarily dismiss the purported class action brought by the plaintiff on behalf of himself and the persons described above. The Action alleged claims for false and misleading advertising, unfair and deceptive trade practices, negligent misrepresentation, breach of warranty and common law fraud against Cadbury Schweppes, PLC and Cadbury Schweppes, Inc., and is pending in the Supreme Court of the State of New York, County of New York. The parties have agreed to voluntarily discontinue the Action without prejudice. Neither plaintiff nor his counsel has received or will receive consideration directly or indirectly for the voluntary discontinuance without prejudice of the Action.
