The charges were filed with regional offices of the National Labor Relations Board National Labor Relations Board (NLRB), independent agency of the U.S. government created under the National Labor Relations Act of 1935 (Wagner Act), and amended by the acts of 1947 (Taft-Hartley Labor Act) and 1959 (Landrum-Griffin Act), which affirmed labor's right  in Chicago and in Winston-Salem, N.C.

"The corporate misconduct outlined in these charges has undermined the bargaining process and caused the two strikes against Rexam as it became impossible to reach a settlement that is satisfactory to our members," said USW International Vice President Fred Redmond, chief negotiator for the union. "As a result, we believe that our two strikes are unfair labor practice strikes."

Some 900 USW members began two unfair labor practice strikes against Rexam on April 10 at nine plant locations in the United States. The employees twice rejected contract proposals by secret ballot vote, the last time on April 4.

The NLRB filing in Chicago covers corporate activity at each of eight plants covered by a Master collective bargaining agreement The contractual agreement between an employer and a Labor Union that governs wages, hours, and working conditions for employees and which can be enforced against both the employer and the union for failure to comply with its terms. . Those locations are Chicago, Phoenix, Ariz., Birmingham, Ala., St. Paul, Minn., Whitehouse, Ohio, Chatsworth, Calif., Bishopville, S.C., and Oklahoma City. The second filing covers a facility in Winston-Salem that employs approximately 170 USW members but is not part of the Master Agreement.

Both filings alleged the company engaged in direct dealing with bargaining unit employees over terms and conditions of employment conditions of employment

, threatened non-members and probationary employees with adverse action if they honored the USW's picket line and engaged without justification in video surveillance of employees who were engaged in lawful, peaceful picketing activity.

In addition, the charge filed in Chicago with regard to the Master Agreement plants alleges, among other things, that the company has unlawfully terminated the accident and sickness benefits of eligible employees, made unilateral changes to the health insurance benefits of employees and provided assistance for employees to resign from membership in the union.

The USW, the largest industrial union in North America, represents more than 850,000 workers in the United States and Canada.
