New York State Appellate Court Rejects Hospitals' Claims Against Tobacco Companies.

On January 27, 2003, Philip Morris Companies Inc. changed its name to Altria Group, Inc. Even under this new name, Altria continues to own 100% of Philip Morris USA.
 Inc. and other tobacco companies by 170 New York hospitals seeking damages for costs they allegedly incurred to treat injured smokers.

The appeals court ruled that the hospitals' claims -- which depended upon alleged injuries sustained by hundreds of thousands of unidentified individuals -- were "entirely derivative" of the alleged harm suffered by individual patients and were therefore "too remote to permit recovery."

 Supreme Court, and the plaintiffs appealed. Today's decision represents the fifteenth consecutive time an appeals court has rejected, in a unanimous opinion, these types of indirect claims against tobacco companies.
