New Garnishment Law Tougher -- Consumers, Employers and Courts to be Burdened; Consumer Credit Counseling the Best Alternative.CLEVELAND--(BUSINESS WIRE)--March 29, 1999--On March 30, 1999, a new garnishee An individual who holds money or property that belongs to a debtor subject to an attachment proceeding by a creditor. For example, when an individual owes money but has for a source of income only a salary, a creditor might initiate Garnishment proceedings. law will go into effect in Ohio. Previously, creditors needed to file for a garnishee each month; filing will now be continuous. The effects of this new law are expected to add an extra burden to consumers, employers and the municipal courts in Ohio. The garnishment consists of a warning, in the form of a judgment, to the third party, called the garnishee, not to deliver the process, or the alternatives of trusteeship or bankruptcy. CCCS provides free counseling and debt management programs to consumers. Consumers need to act quickly, after they are notified of an intent to garnishee. They will have a window of only 15 days during which they may make an appointment with CCCS in order to avoid wage attachment. Employers may expect greatly increased reporting duties and paperwork. Small employers may find the process an overwhelming encumbrance A burden, obstruction, or impediment on property that lessens its value or makes it less marketable. An encumbrance (also spelled incumbrance) is any right or interest that exists in someone other than the owner of an estate and that restricts or impairs the transfer of the estate or . Consumer Credit Counseling Service is available to make employee presentations on the subject of dealing with debt. As of the end of March, garnishments will be continuous orders which may last until the debt is paid to a creditor in-full. If a second creditor files next, the first creditor's garnishees will be limited to 182 days. In cases where multiple creditors file, there will be a "stacking" process whereby creditors would queue up for six-month terms of garnishees. To avoid being garnisheed, consumers may pay the debt in-full, arrange through their employer to pay the garnishment amount, file for trusteeship or bankruptcy, or use a non-profit, credit counseling service.
