, who was convicted of driving under the influence of alcohol in January 1998 and June 1993, was driving a 1959 Willys Jeep on a remote road when it crashed into a culvert, killing Matthew Mazza of Calabasas and injuring McCarthy and two other passengers.

McCarthy, who is free on $250,000 bond, appeared Tuesday for his arraignment A criminal proceeding at which the defendant is officially called before a court of competent jurisdiction, informed of the offense charged in the complaint, information, indictment, or other charging document, and asked to enter a plea of guilty, not guilty, or as otherwise permitted  in Kern County Superior Court in Bakersfield. Trial is scheduled to begin Nov. 19.

A preliminary breath test following the 7 p.m. crash showed that McCarthy had a blood-alcohol reading of 0.159, almost double the 0.08 limit for driving drunk, officials said.

Authorities said that McCarthy was driving a Jeep with Matthew and McCarthy's 14-year-old son, Colin, crouched in back and Chris Cunningham, 29, of Pico Rivera riding in the front seat. They were going to bring gasoline to a motorcycle that had run out of gas.

McCarthy was traveling 50 to 60 mph when he hit a three-foot-deep, 15-foot-wide culvert. Matthew was thrown 138 feet and suffered a severe head injury. Cunningham suffered a broken back and the elder McCarthy a broken shoulder, officials said. Their conditions were unavailable Thursday.

The younger McCarthy suffered what officials said were minor injuries. The four friends were with a group that had gone Memorial Day weekend to Dove Springs Canyon, a popular off-road area near Red Rock Canyon State Park, approximately 110 miles north of Los Angeles.
