NORTHEASTERN PENNSYLVANIA BUSINESSMAN OWES STATE $225,000,
 CHARGES ALLEGE
HARRISBURG, Pa., Sept. 18 /PRNewswire/ -- The operator of three northeastern Pennsylvania businesses pocketed more than $225,000 in sales tax revenue, Attorney General Ernie Preate Jr. charged today.
A criminal complaint filed by agents of Preate's Criminal Investigation and Prosecution Section identifies the suspect as Charles J. McAvoy, 49, of Wyoming RD 3, Luzerne County.
McAvoy is listed in the complaint as the owner and operator of Northeast Drywall Supply Co., 359 Laird St., Wilkes-Barre; Northeast Drywall Supply, 1 Gypsum Road, Stroudsburg RD 2, and Priority Leasing Co., 269 Pierce St., Kingston.
The charges allege that McAvoy failed to remit to the state Revenue Department a total of $225,757 in sales tax collected from customers at his three businesses between October 1990 and February 1992.
McAvoy also failed to file three required monthly sales tax returns for one of the businesses and sent the Revenue Department three bad checks totaling $14,754.
The complaint charges the suspect with 26 counts of failure to remit sales tax and three counts each of failure to file sales tax returns and issuing bad checks.
The sales tax charges carry a maximum penalty of one year in prison and a $1,000 fine per count, while the maximum on each of the bad checks charges is two years and $5,000.
Deputy Attorney General Lois H. Lichtenwalner, who will prosecute the case, said the complaint was filed with Harrisburg District Justice Horace A. Lowery. He will issue a summons ordering McAvoy to appear before him for a preliminary hearing at a later date.
Preate said the charges resulted from evidence developed by the Revenue Department's Criminal Tax Investigation Division.
