NICODERM CLEARS LEGAL HURDLE ON ITS WAY
TO HELP SMOKERS KICK THE HABIT
KANSAS CITY, Mo., Dec. 13 /PRNewswire/ -- Marion Merrell Dow Inc. (NYSE: MKC) and ALZA Corp. (AMEX: AZA) of Palo Alto, Calif., today announced plans for the immediate introduction and shipment of Nicoderm(R), the first transdermal nicotine patch for smoking cessation approved in the U.S., following court action in a patent infringement lawsuit that had delayed introduction of the product.
The U.S. District Court, Northern District of California, today lifted a Nov. 21 order that had restrained the companies from selling Nicoderm. The court also denied a request by Elan Corp. plc and American Cyanamid for a preliminary injunction to hold up Nicoderm sales.
The companies said shipments will begin today and Nicoderm should be available in pharmacies, by prescription only, in time to help the many people who make New Year's resolutions to stop smoking.
The patent issues raised by Elan and American Cyanamid will be resolved by the court at a later date. Marion Merrell Dow and ALZA vigorously dispute the allegation of infringement in this case.
Nicoderm, manufactured by ALZA and marketed by Marion Merrell Dow, delivers nicotine over 24 hours, thus reducing the nicotine craving many smokers experience. Nicoderm features advanced technology that incorporates a unique rate-controlling membrane to deliver nicotine. Thus, the rate of delivery to the body is controlled primarily by the rate of release of nicotine from the system. Nicoderm helps smokers stop smoking, reduce nicotine craving and ultimately eliminate their nicotine use by tapering off the dosage levels of the nicotine patches.
